Dutch Court Denies Bail for Tornado Cash Developer

What is Tornado Cash?

Tornado Cash is a cryptocurrency mixer designed to enhance transaction privacy on the Ethereum network. Its primary function is to consolidate multiple transactions into a single pool, making it difficult to trace the origin and destination of funds. Tornado Cash has been at the center of controversy due to its involvement in money laundering and has been subject to various investigations.

Bail Denial Decision

On July 12, 2024, Dutch authorities decided to deny the bail request for Alexey Percev, a developer of Tornado Cash. Percev will remain in custody pending an appeal court decision. The court in the city of 's-Hertogenbosch, Netherlands, announced this decision.

Percev's attorneys, Keith Cheng and Judith de Boer, filed a motion for his release on bail, but the court found their arguments insufficient. The court expressed concerns about the high likelihood of Percev fleeing before the final verdict is rendered.

Case Developments

In August 2022, Alexey Percev was arrested in the Netherlands, marking a significant event in the broader investigation related to Tornado Cash. A year prior, the FBI had arrested Tornado Cash co-founder Roman Storm, and the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC) had added another member of the mixer’s development team, Roman Semenov, to its sanctions list. Semenov is currently wanted.

The court has permitted Alexey Percev to use a computer to prepare his defense, allowing him to continue working on his case despite the current restrictions. Percev was found guilty of orchestrating the laundering of approximately $1.2 billion.

These developments highlight the complexity and scale of the investigation surrounding Tornado Cash, and the situation in the Netherlands will be closely monitored by the public and cryptocurrency experts.
